Taking into account one of the meanings of the expression binding precedent and stipulating a definition for that meaning, this article aims to contribute to the concept's structural characterization. By this I mean the effort to identify the legal norms on which the existence and functioning of binding precedents depend and to show that these norms constitute a group of Hohfeldian legal relations between the courts whose precedents must be followed, the courts that must follow them, and the individuals whose (...) legal situations are as a result modified by the observance and the breach of those precedents. This paper uses the critical reflections of Jeffrey Barash on the matter of the symbol in the works of Paul Ricœur. The interpreter, interested mostly in the locus of collective memory that can be found in Memory, History, Forgetting, considers the urge of abandoning Husserl’s concept of analogy, used by Ricœur. For this purpose, he draws our attention to the concept of symbol that Ricœur avoids developing in the context of the discussion on memory. Consequently, he researches the background of (...) the matter in Freud and Philosophy and Time and Narrative. In this paper, I will try to show that the course imparted in Chicago in 1975, Lectures on Ideology and Utopia, is the appropriate work to answer from the perspective of symbolism to the problems of the constitution of collective memory through the contribution made by Ricœur in his work on ideology. Studies investigating the relationship between artificial intelligence and science tend to adopt a partial view. There is no broad and holistic view that synthesizes the channels through which this interaction occurs. Our goal is to systematically map the influence of the latest AI techniques on science. We draw on the work of Nathan Rosenberg to develop a taxonomy of the effects of technology on science. The proposed framework comprises four categories of technology effects on science: intellectual, economic, experimental and instrumental. (...) The application of the framework in the relationship between ML/DL and science allowed the identification of multiple triggers activated by the new techniques in the scientific field. Visualizing these different channels of influence allows us to identify two pressing, emerging issues. The first is the concentration of experimental effects in a few companies, which indicates a reinforcement effect between more data on the phenomenon and more capacity to commercialize the technique. The second is the diffusion of new techniques lacking in explanation throughout the fabric of science. The value of this article is twofold. First, it provides a simple framework to assess the relations between technology and science. Second, it provides this broad and holistic view of the influence of new AI techniques on science. More specifically, the article details the channels through which this relationship occurs, the nature of these channels and the loci in which the potential effects on science unfolds. (shrink)

And also, display the differences and similarities between the water management systems used, as to better understand the criteria developed to orientate the place of settlements and also of certain urban characteristics chosen by the Greeks, between the VIII and IV centuries B.C.

This paper presents an approach to the belief system based on a computational framework in three levels: first, the logic level with the definition of binary local rules, second, the arithmetic level with the definition of recursive functions and finally the behavioural level with the definition of a recursive construction pattern. Social communication is achieved when different beliefs are expressed, modified, propagated and shared through social nets. This approach is useful to mimic the belief system because the defined functions provide (...) different ways to process the same incoming information as well as a means to propagate it. Our model also provides a means to cross different beliefs so, any incoming information can be processed many times by the same or different functions as it occurs is social nets. (shrink)

Este artigo propõe-se a refletir sobre a construção do Eu de crianças com cegueira congênita a partir da teoria winnicottiana do amadurecimento. Para Winnicott, a natureza humana é uma questão de psique-soma em constante interação; o ser humano é essencialmente psicossomático, sendo o corpo o primeiro a chegar e a elaboração imaginativa das funções corpóreas o elemento constitutivo e enriquecedor da vida psíquica. Essa concepção da natureza humana parece ser a mais esclarecedora para a compreensão do desenvolvimento e da construção (...) do eu das crianças com cegueira congênita; crianças que chegam ao mundo com uma constituição orgânica significativamente diferente, que as conduzem por caminhos peculiares em seu processo de percepção e amadurecimento. Muitas dificuldades são apontadas na descrição do desenvolvimento dessas crianças: passividade de ego, ausência de interesse por objetos, atrasos na aquisição de capacidades, desinteresse por brincadeiras e verbalismo. Comportamentos considerados semelhantes aos de crianças autistas. Acreditamos que, a partir da teoria winnicottiana do desenvolvimento, muitas dessas vicissitudes podem ser compreendidas e alguns procedimentos terapêuticos indicados.This article proposes a reflection upon the ego development of children with congenital blindness through maturation theory. For Winnicott the human nature is a matter of psyche-some in constant interaction, the human being is essentially psychosomatic, in which the body is the first to arrive and the imaginative elaboration of the body functions are the elements that constitute and enrich the psychic life. This conception of the human nature seems to be the most clarifying for the comprehension of the development and the self constitution of the children with congenital blindness; children who arrive into the world with a significantly different organic constitution, which conducts them through a peculiar path in their process of perception and maturity. Many difficulties are pointed out on the description of the development of these children: passivity of the ego, absence of interest for objects, delay on the acquisition of abilities, disinterest for children's play, verbalism. Behaviors similar to those of autistic children. We believe that through Winnicott's developmental theory a lot of these vicissitudes can be comprehended and some therapeutic procedures can be indicated. (shrink)

O presente trabalho propõe-se analisar a importância das propostas winnicottianas de intervenção às pessoas com deficiências. Depois de refletir sobre a intervenção, apresentada pelo autor a partir de suas experiências como pediatra, observando bebês e suas mães, e como psicanalista, no atendimento dos "casos fronteiriços", foram analisados três aspectos: o uso desses conceitos para a compreensão do desenvolvimento de pessoas com deficiência, sua relevância no entendimento da maior intensidade de riscos a que estão expostos e a pertinência dos pressupostos da (...) clínica do amadurecimento com esses indivíduos. Algumas vinhetas de um caso são utilizadas para exemplificar o uso da teoria de Winnicott na compreensão do cliente e da técnica utilizada.The purpose of this text is to analyze the importance of winnicottian concepts of intervention with disabled persons. After reflecting on the concepts proposed by the author, based on his pediatric experiences, observing babies and their mothers, and as psychoanalyst, attending borderline cases, three aspects have been analyzed: the application of these concepts with regard to understanding the development of disabled persons, their relevance to the understanding of the intensive risk to which individuals are exposed and the pertinence of the proposals of the maturation clinic near these individuals. Considerando as crianças como atores sociais (com voz e ação) competentes para a interpretação do contexto em que se inserem, apresenta-se no presente artigo uma reflexão sobre a sua importância, enquanto sujeitos e participantes na investigação partilhada. Através da participação das crianças como investigadoras em dois estudos de opinião, pretende-se discutir as respetivas possibilidades e limites, enquanto metodologia participativa na Educação Básica. A informação proveniente das crianças forneceu pistas de intervenção aplicadas à escola.

En este texto partiremos de la conocida tensión cinematográfica entre la imagen y la narración, refiriendo a un caso concreto de cine mexicano tipológico costumbrista. Es un género que se distingue por una trama débil constituida por secuencias con un importante peso mostrativo o “descriptivo”, más que narrativo y el espectador se entretiene en el reconocimiento de los estereotipos, obteniendo un goce mimético de reconocimiento. Para abordar tal reconocimiento mimético distinguiremos entre los imaginarios literarios y los imaginarios fílmicos. Los imaginarios (...) literarios son esquemas faltos de concreción. Por el contrario, los imaginarios fílmicos no son lo absoluto una cuestión de la imaginación más o menos vaga, sino que dada su base fotográfica presentan girones de la realidad tal cual es en su apariencia. Este imaginario fílmico ya no consta de imágenes de la mera imaginación, al gusto del que se las imagina, sino que consta de fragmentos fotográficos de la apariencia real, por lo que esas imágenes de calidad fotográfica tienden a generan de inmediato aprobación o rechazo. Puede ser que se lea algo que no gusta y entonces tiende a dejarse de lado, pero es más difícil dejar de lado algo que, aunque no guste no se leyó sino se vio. Para analizar el género de narrativa débil tipologizante recurrimos a la teoría de D. Bordwell sobre la construcción de la historia combinándola con la teoría de R. Barthes acera de los núcleos, catálisis, informantes e indicios narrativos. (shrink)

To research teachers’ priorities on what was to be taught and learned during the COVID-19 lockdown, we asked Spanish Primary and Secondary teachers to choose and describe the activity they preferred among those carried out with their students during the pandemic. Our interest was to investigate what really happened in the classrooms, the type of learning favored by the practices, and the agreement between the teacher’s goals and their teaching We obtained 272 activities that we analyzed according to the proposed (...) goals, the types of learning worked, and the kind of teaching promoted. Results showed that most teachers proposed content-centered activities, oriented above all to verbal learning. There were clear differences between the proposed goals, partly student-centered, and what was really taught, essentially content-centered. We obtained two teaching profiles, one reproductive and the other constructive. (shrink)

Este estudio tuvo como objetivo caracterizar investigaciones sobre representaciones sociales de docentes y estudiantes acerca de la escritura en la educación superior. La revisión sistemática se efectuó siguiendo la metodología propuesta por la Declaración PRISMA. La búsqueda, que fue realizada en las bases de datos WOS, Scopus, Scielo y ERIC, permitió identificar 20 artículos entre los que predomina el enfoque cualitativo. Como elementos recurrentes se destacan la necesidad de que en la universidad se enseñe explícitamente a escribir y la persistencia (...) de representaciones, que vinculan la escritura con la evaluación. Traditionally, in Spain bullfighting represents an ancient and well-respected tradition and a combined brand of sport, art and national identity. However, bullfighting has received considerable criticism from various segments of society, with the concomitant rise of the animal rights movement. The paper reports a survey of the Spanish citizens using a face-to-face survey during January 2016 with a total sample of 2522 citizens. The survey asked about degree of liking and approving; culture, art and national identity; socio-economic aspects; emotional perception (...) and animal welfare. The hypothesis proposed that the perception of bullfights may be affected by gender, age, occupation, origin and nationality of the persons surveyed. The hypothesis was confirmed. The majority of citizens surveyed do not like bullfights and great majorities do not attend or watch such events. Two extreme clusters were described: one representing favorable attitude towards bullfighting and other against bullfighting. The proportion of indifferent persons was important. Women and young people showed a more favorable attitude towards animal welfare issues associated with these events. Rural people were more accepting bullfights than urban people. Students were more anti-bullfight than those in other occupations. Additionally, technical economic factors made people favor more bullfights. The growth of claim against bullfights establishes an element of a far more multifaceted phenomenon that animal cruelty per se and support of a new paradigm called social change in countries as Spain. In an unprecedented fashion, COVID-19 has impacted the work-family interface since March 2020. As one of the COVID-19 pandemic consequences, remote work became widely adopted. Furthermore, it is expected that other pandemics will occur in the future. Hence, this context represents a chance to gain deeper insight into telecommuters’ work and family spheres. Following PRISMA guidelines, the present narrative review aims to synthesise the COVID-19 impact on the work-family interface. Out of 121 screened references, 32 articles that measure at least (...) one of the following variables–work-family conflict, work-family enrichment, work-family balance, and boundary management were included. A thematic analysis using NVIVO12 was conducted, from which eight topics emerged: “paid workload, unpaid workload, and gender”; “well-being and gender”; “job resources, job demands, and gender”; “couples and gender”; “parenting and gender”; “occurrence of work-family enrichment with work-family conflict and gender”; “enforced blurred boundaries, its management, and gender”; “boundary management impact on work-family conflict, work-family enrichment, and work-family balance.” Overall, studies point out that COVID-19 had a complex effect on both work-family conflict and work-family balance, making it difficult to state whether these variables were mitigated or augmented. Findings demonstrated that COVID-19 produced little changes in work-family enrichment. As for the COVID-19 impact on work-family boundary management, individuals had to create new tactics to manage them due to the absence of boundaries between both systems. The impact of contextual influences on human resource management and management more generally has been the focus of much scholarly interest. However, we still know very little about how context impacts on the practice of ethical HRM specifically. Therefore, drawing on 59 in-depth interviews with HR practitioners in Brazil, Colombia and the UK, this paper theorizes how they perceive the ethical dimensions of their roles within their respective national contexts and how the way they act in relation to them is (...) informed, shaped and directed by the institutional context. In doing so it provides an important insight into three key themes: first, the views of HRM practitioners and managers about ethical HRM and how they articulate what it means to be ethical; second, how they respond to perceived ethical dilemmas; and third, how their responses are influenced by institutional forces and associated beliefs, values and scripts. In addition to providing an ‘emic’ perspective of this increasingly important topic and theorizing the experience and practice of ethical HRM, the paper answers calls for more international comparisons of ethical HRM practice in contemporary organizations. A explicação bioquímica da dominância permite a reinterpretação do fenômeno e da relação entre a genética da transmissão e a genética molecular. O objetivo deste trabalho é discutir sobre as explicações de dominância e recessividade a partir da proposta de Mendel, e como a genética molecular contemporânea contribuiu nesse sentido. Para tanto, considerar-se-á alguns autores que, no século XX, procuraram explicar o fenômeno bem como aspectos referentes à articulação entre genética da transmissão e genética molecular na interpretação da dominância. O (...) artigo tratará de explicações para a dominância em dois níveis, o fenotípico (original de Mendel) e o molecular, visando mostrar que, sob o enfoque epistemológico, elas não tratam do mesmo fenômeno, isto é, são conhecimentos distintos e que historicamente se mesclaram. In this article I present the analysis of the syncategorematic term ‘omnis’ in the commentaries on the Topics by the Parisian masters of Arts Boethius of Dacia and Radulphus Brito. I shall focus on the different relations between subject, predicate and particular instances that obtain in universally quantified statements, and in particular on the relations that obtain in universally quantified statements with an empty subject. I also attempt to highlight some continuities and ruptures with respect to this problem in its (...) 13th-century treatments, by comparing Boethius and Brito’s analyses with the earlier analyses put forth by Peter of Spain and William of Sherwood. Background In Spain, there has been great effort by lawmakers to put Advance Directives into practice since 2002. At the same time, the field of bioethics has been on the rise, a discipline that has spurred debate on the right of patients to exercise their autonomy. Despite all this, the implementation of ADs can be said to have failed in Spain, because its prevalence is very low, there is a great lack of knowledge about them and they have very little (...) impact on clinical decisions. The purpose of this article is to analyze and discuss the main reasons for the failure of ADs in Spain. Main body The main reasons why ADs have no impact on clinical practice in Spain have been fundamentally four: the training of health professionals about the end of life and AD is lacking; there has been no public process to increase awareness about AD, and therefore people know little about them; the bureaucratic procedure to document and implement ADs is excessively complex and cumbersome, creating a significant barrier to their application; in Spain, the remnants of a paternalistic medical culture continue to exist, which causes shared decision-making to be difficult. Conclusion Due to the four reasons mentioned above, AD have not been a useful tool to help honor patients’ autonomous decisions about their future care and, therefore, they have not achieved their objective. However, despite the difficulties and problems identified, it has also been observed that health care professionals and the Spanish public have a very positive view of AD. Having identified the problems which have kept AD from being successful, strategies must be developed to help improve their implementation into the future. (shrink)

La première position est celle de Simon de Faversham, développée vers 1280 et probablement durant son séjour à la Faculté des arts de Paris. La seconde position est celle de Raoul le Breton, dernier des plus grands (...) maîtres ès arts parisien. Edition of the commentary on Aristotle's De interpretatione by an anonymous Parisian master from the first half of the 13th century.

The article intends to show: a) that the modist Martin of Dacia sides with the traditional reading of the first chapter of Aristotle’s De interpretatione that we find in masters of arts from the first half of the thirteenth century; and b) that the modist Boethius of Dacia is one of the first thirteenth-century scholars to depart from this reading. In fact, Boethius presents us with an account of propositional verification where the terms’ signification is not operational and where the (...) immediate truth-maker of statements like ‘homo est animal’ is an external state of affairs. In Martin’s case, to the contrary, the terms’ signification is operational in his account of propositional verification and the immediate truth-bearer of such statements is a mental composition or division.
